Threat to reverse reforms to labour markets
Comments from Italian commercial law firm

Comments from Gabriele Giambrone, Managing Partner, of Italian law firm Giambrone Law: “The concern is that a Bersani led government would be a real threat to the deregulation of the Italian economy.”

“It is clear that red-tape and inflexible labour laws have been one of the main reasons why the Italian economy has been so poor at attracting inwards investment and generated such weak economic growth over the past decade.”

“Although the reform process under the Monti government was slow, it was progress all the same. A Bersani government would not only mean a dragging of heels in terms of reforms but an actual reversal of key employment reforms that have been achieved.”

Gabriele Giambrone gives the example of reforms to “Article 18” that Bersani has strongly hinted that he would scrap.

Explains Gabriele Giambrone: “Reforms to Article 18 allowed employers to more easily make redundancies for economic reasons. That is a fairly basic right for employers in most countries but now that is under threat in Italy.”

“Scrapping those reforms to Article 18 would be a huge step backwards.”

Threat to deregulation of law firms

Gabriele Giambrone also says that there will be worries that the legal sector, also much in need of reform, will not see progress under Bersani.

Reformers had hopes that reforms to the corporate structure of law firms would allow more consolidation of law firms and easier entry of foreign law firms to the Italian market – both of which would encourage Italian law firm to offer a more cost effective and customer-focused service.

Adds Gabriele Giambrone: “A more left-leaning, or populist government, is likely to see the hobbling of dozens of such business and economic reforms.”

Probate is a legal term which refers to a situation in which a person applies for the right to handle the affairs of a deceased person. It is sometimes also known as ‘estate administration’. Here, we discuss what this term means in a little more detail.

If a person passes away, and has left a will, the executor of that will be expected to handle the deceased’s affairs. However, even as that person’s executor, they do not automatically have the right to deal with the estate left behind; they will need to apply for a grant of probate. This is because the financial institution or relevant authority which holds the assets of the deceased – such as the building society or bank – will not permit a transfer of asset control without first seeing a grant of probate. But, if the estate is quite small, there are some organisations which will transfer control upon viewing a death certificate, but this would be at their discretion, and is not a given.

Applying for probate is usually done via the probate registry office in the court. The grant itself comes in the form of a legal document, which provides the executor with written authorisation to handle the possessions, money and property which belonged to the deceased. This document can be shown by the executor when they need to prove to, for example, the bank, that they have the right to access that person’s funds and arrange their finances. If a person has been named as an executor on a will, but for some reason is unable to apply for probate, then they have the right to appoint another person to apply for it instead. The appointed person – referred to as an Attorney – will need to bring a letter from the executor with them to the probate registry, which explains why the executor cannot apply.

If no will has been left by the deceased, then under normal circumstances, a close relative – a sibling, parent or spouse, will apply for a grant of probate so that they can sort out the person’s estate. In such cases, they need to apply for a grant of letter of administration; if they are given the grant, then they are considered, from a legal perspective, to be the administrator of the estate from then onwards.

The 2012 Parc International des Expositions held on 28-30 November in Tunisia, reports Gabriele Giambrone of Giambrone Law, sought to increase exportation of Tunisian olive oil products around the world. Special attention was given to increasing exportation to countries in Europe as well as to the Middle East.

The event was held at the Parc des Expositions du Kram which is one of the best locations for such activities due to it being set on an expansive 7 hectare of beautiful tropical landscape. The Expo Centre is also surrounded by spacious parking and hotels, restaurants, and entertainment establishments.

Giambrone Law adds that numerous representatives from both Tunisian and international companies attended the Expo which was organized by several associations dealing in trade and investment expansion. Representatives, including Giorgio Bianco and Maitre Dhouda Allagui from the local Tunisia law office, met at a host of themed tables to discuss a variety of business venues.
